The Digicel ‘Talk for Free’ Promotion
Terms and Conditions
1. Agreement
The Talk for Free terms and conditions (“these terms and conditions”) shall govern the relationship between Digicel (Cayman) Limited (hereinafter referred to as "we", "us" "our" and "the Company") and the user (hereinafter referred to as "you", "your" and "the Customer") of the Company’s ‘Talk for Free’ prepaid promotion (hereafter referred to as “Talk for Free”).
By using your Digicel mobile service, you have agreed to these terms and conditions.
We reserve the right to amend or unilaterally change Talk for Free and/or these terms and conditions subject to notifying you of such amendments or changes. Such notification may be by way of advertisement in the national media, SMS text messaging and/or our website. If your Digicel mobile phone is used by you after notice of any amendment or change, then you shall be deemed to have accepted same.
The Talk for Free Promotion commenced on September 12, 2008.
This agreement is governed by the Laws of the Cayman Islands.
2. Promotion Description
The Talk for Free Promotion allows you, the prepaid customer to make a local Digicel to Digicel call (in the Cayman Islands) and talk for 3 minutes with the next 30 minutes free of charge.
The Talk for Free Promotion also allows you, the customer to make an international call on weekends to Digicel Caribbean countries, USA, and Canada, talk for 10 minutes with the next 30 minutes free of charge. The customer must call a Digicel customer in the Caribbean islands or any mobile or fixed line customer in the USA or Canada that have numbers on the US and Canadian networks, using your Digicel prepaid phone. Regular international calling rates apply to destinations outside of the select overseas locations. The international benefits of Talk for Free (30 FREE minutes) apply on weekends only.
After the 30 minutes is done, and the customer is still on the call, the call will begin to rate at the regular rate. This may vary according to where you are calling and the time of day.
The Digicel Caribbean countries that are in this promotion are ABC Islands, Anguilla, Barbados, Bermuda, Dominica, Grenada, Guadeloupe, Jamaica, Martinique, St Kitts & Nevis, St Lucia, St Vincent & the Grenadines, Suriname, Trinidad & Tobago, Turks & Caicos.
Digicel Caribbean countries that are not included are Guyana and French Guiana, and Antigua.
Where you make a call from your Digicel phone to the a local Digicel phone in the Cayman Islands when you are outside of the Cayman Islands you will be billed at regular roaming rates.
When you make a call from your Digicel phone to a local Cayman Islands Digicel phone number when the customer is outside of the Cayman Islands you will not be charged, however the customer with the local Digicel Phone numbers will be charged regular roaming rates for roaming incoming usage.
4. Fair Use Policy
Talk for Free Promotion is offered for the personal use of individuals and not commercial use. Any usage by an individual that in our sole discretion is intended for financial gain or profit by you will result in the immediate termination of Talk for Free Promotion service to you.
In addition, the Company and you agree that we reserve the right to terminate a subscriber’s Talk for Free Promotion usage service forthwith if in our sole opinion Talk for Free is being abused, such abuse to include but not be limited to:-
- open circuits without voice conversations,
- any usage in excess of 10,000 minutes per month in calls,
- circuits being used for data transmission and/or non-voice communication,
- installation of any SIMS being used for the Talk for Free promotion in a PBX/switchboard, and
- general abuse intended to undermine the mobile telecommunications network provided by the Company
